Asbestos Hazards Are Serious Business

Posted by admin on Apr 26, 2010

The basic health hazards relating to asbestos are certainly not a secret. Through public awareness, a high number of mesothelioma lawsuits, and of course public education, asbestos is known to cause a very specific type of lung cancer that attacks the lining of the lung known as mesothelioma.

Mesothelioma lawsuits are not quite as cut and dry as we would like to think they are. It should be a simple matter of asking the responsible party to step up and assist those detrimentally affected by asbestos. However, because of changes in regulations, it takes a qualified mesothelioma lawyer to help you file a mesothelioma lawsuit.

Mesothelioma settlements range anywhere from nominal to significant, depending on the usage of asbestos, the time period in which the building was constructed, the current laws at the time, and the quality of the mesothelioma lawyer.

In 1970, the use of asbestos was limited, but not banned. Public awareness coupled with significant mesothelioma lawsuits and mesothelioma settlements have led to a serious decrease of asbestos use, but current construction is still permitted, and often chooses to use asbestos.

Individuals who work or have worked with asbestos are at a very high risk for asbestos related illnesses, and those who have been diagnosed even years later have been able to successfully file mesothelioma lawsuits and are typically granted mesothelioma settlements provided their mesothelioma lawyer is able to thoroughly understand the laws and how they apply to each individual case.

Because mesothelioma lawsuits are not as cut and dry as we would like to think they are, there are individuals who are told that they do not qualify for a mesothelioma settlement by an incompetent mesothelioma lawyer. It is best to check with two or even three mesothelioma lawyers to find out how the asbestos laws best relates to your case. Most mesothelioma lawyers will provide an initial consultation free of charge.

An internet search will provide a list of mesothelioma lawyers that are capable of representing you mesothelioma lawsuit. As with any other business, the proof is in the pudding. When choosing a mesothelioma lawyer, check their record for attaining mesothelioma settlements.

People living with asbestos related illnesses should not have to suffer the pain alone. Sometimes a mesothelioma lawyer has had enough experience in dealing with mesothelioma lawsuits that they can even recommend treatment options that have worked well for other clients, or at the very least, drop the name of a facility in your lap. Mesothelioma lawyers are attorneys who are ready to fight for the rights of the injured. There is great care and concern in dealing with mesothelioma lawsuits and obtaining mesothelioma settlements. Don’t hesitate. You’re health and your time is too valuable.

Asbestos Litigation in California

Posted by admin on Apr 23, 2010

California asbestos laws have changed over the past few years, showing more favor toward the side of companies that have violated California asbestos laws prior to the year 1980.

Asbestos litigation has taken on a whole new meaning as lawyers have had to take on this new specialty and grow into asbestos lawyers. What does all this mean for California residents in need of asbestos litigation?

It means that the lawsuit being filed by California based asbestos lawyers are under a more scrutinous attack, which mean the time to enter into an asbestos lawsuit in the state of California is now.

Asbestos lawyers recommended a consultation for any individual who has been exposed needlessly to asbestos, even if they have not yet been diagnosed with Mesothelioma, the cancer specifically caused by asbestos exposure.

Filing asbestos litigation cases prior to determining that the exposed victim is ill is not uncommon. This is done to protect the rights of the victim while the California asbestos laws allow for a tolerable and reasonable settlement, as California asbestos laws change often enough to complicate cases in the future.

Of course, victims with open and shut cases will always have some favor in the eyes of California asbestos laws, but open and shut cases are harder and harder to come by. Most asbestos litigation isn’t as simple as it seems. Often people were employed by more than one company within their working lifetime and proving that the asbestos exposure that is prompting the asbestos litigation came from any one particular company is not always simple.

Many companies who have experienced asbestos litigation understand the penalties for intentionally or negligently exposing their employees to asbestos, and have chosen unscrupulous routes to avoid ending up in any additional asbestos litigation.

California asbestos law is complex and requires an expert to help decipher it. It is important for those considering pursuing asbestos litigation to get the professional counsel that an asbestos lawyer can offer.

Asbestos lawyers are up to date on all the changes in California asbestos law and can help those who were needlessly exposed to asbestos understand their rights within the realms of the ever changing California asbestos laws. Naturally, the entire state of affairs is completely unfair, and people need to understand that while companies may be empathetic to a victim’s plight, most companies by now have changed hands, or at least management, and are now also trying to protect the rights of the current workforce, even if that means allowing a Mesothelioma victim flounder in their pain, suffering, and exorbitant medical bills.

This is of course unfair to those who worked tirelessly for these companies in the past, and it is a fine ethical line for the companies of the present to find a middle ground to protect all employees, past, present, and even future.

California asbestos laws are not the only asbestos laws which have undergone change over the past few years. Asbestos lawyers all over the country are having to fight harder for victim’s rights. However, in most cases, these victims are still receiving fair judgments and settlement offers, at least for now.

There have been asbestos litigation cases that have been filed on behalf of those who are not sick and may or may not become ill in the future, however the threat that asbestos exposure brings with it is often enough to enter into asbestos litigation. It takes a talented asbestos lawyer, one who is on top of every change in California asbestos laws, to complete these premature examples of asbestos litigation, however the claims are still very legitimate.

The best advice an asbestos lawyer can offer anyone wondering if they qualify for asbestos litigation under the current California asbestos laws is to receive a consultation. Most asbestos lawyers will in fact meet with a client with a potential claim free of charge in order to determine if the information provided is adequate for entering into asbestos litigation.

A consultation can place the minds of potential and actual victims at ease as they attempt to make decisions about their future. Asbestos litigation is a complex field, and not every average attorney can truly handle the specified laws that relate to asbestos cases.

Just as a victim of road rage would not hire an asbestos lawyer, victims of asbestos exposure should not hire an attorney not equipped to handle the intricate California asbestos laws associated with asbestos exposure in the state of California. It is of course, common sense.

What You Must Do to Make The Asbestos Companies Pay

Posted by admin on Apr 22, 2010

Asbestos exposure is linked to several deadly diseases, including mesothelioma, lung cancer and asbestosis. More than 3,000 Americans are diagnosed every year with mesothelioma, a rare and extremely lethal form of cancer that is directly caused by exposure to asbestos. Since as early as the 1920s, asbestos companies have known that their products are dangerous and even deadly – yet they have continued to manufacture asbestos. If you or a family member is afflicted with mesothelioma or another asbestos disease, you are entitled to compensation.

Finding a reputable and aggressive attorney to file an asbestos lawsuit on your behalf is the first step in receiving the settlement you deserve. Given that asbestos-related diseases such as mesothelioma are extremely lethal, the average life expectancy after diagnosis is less than two years – high settlements are increasingly common. Multi-million dollar settlements enable victims to be compensated for their pain, suffering and expenses, and for family members to be protected financially when they are forced to face life without their loved one.

In order to make the asbestos companies pay you the settlement you deserve, you will need to present your attorney with several important pieces of information. First, it is beneficial to provide documented proof that you worked, or were deployed, in a situation that exposed you to asbestos. Be prepared to provide your asbestos lawyer with the name of the company you worked for and the time frame of your employment, as well as a description of your job. If you are not able to pinpoint the time and location of your exposure, many attorneys employ private investigators to research your claim and bolster your case.

You should also plan to provide your Asbestos Attorney with medical records regarding your specific diagnosis and prognosis. Your medical records or those of your loved ones will help to form an essential picture of the degree of your pain and suffering. This will aid a jury in affixing a dollar value to your asbestos award. If your case does not reach the trial stage, this information will bolster your attorneys negotiating position with the asbestos companies, who will try to get away with as small a negotiated settlement as possible.

Most importantly, you must act quickly to get the compensation you deserve from the asbestos companies. Many states have statutes of limitation, which dictate how long you have to file a claim. Since the diseases caused by asbestos exposure can take up to fifty years to manifest themselves, time may be of the essence.

the attorneys will let you know.
it takes years, especially if it is simple exposure and how massive of exposure.
my dad died of mesothelioma,so depending on what is being filed and extent of exposure it may be waiting for cause and proof from death also.
there are so many in bank ruptcey that it will take awhile for the judges to distribute settlements from the assets of the companies also.
if it is going to the estate then the executor should have the information, usually they will only speak to this person also

What did you use as alternative treatment to cure and survive mesothelioma asbestos cancer?

Posted by admin on Apr 21, 2010

Hi, I’m doing a new web site about diagnosis malignant mesothelioma titled http://www.diagnosis-malignant-mesothelioma-prognosis-claims-settlement.com and true stories about people diagnosed with mesothelioma Asbestos Cancer and USED AN ALTERNATIVE TREATMENT TO SURVIVE LONGER THAN 24 MONTHS . This cancer normally kills people within 24 months, but some survive longer.
I will recognize you as the source
Thanks.

The ONLY treatment I’ve ever seen work (and work often!) is the Immuno Augmentive Therapy (IAT) Clinic in Freeport Grand Bahamas. They are run by British and Bahamian medical doctors, and are in my opinion by far the best alternative cancer treatment center in the world.
For some reason, their treatment (small injections you take several times a day containing immune system proteins) works especially well with mesothelioma, and they are well known for treating it, and often get referrels from Stateside and British MD.s.
Visit their website at either…
